1. Acceptance of Terms

By accessing or using FitTo ("the Service"), operated by FitTo ("we," "us," or "our") and available at fitto.fun, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. Our Service provides an AI-powered fashion catalog generation platform that enables companies to upload product designs, create AI models, generate virtual try-on images, and build PDF catalogs.

2. Account Responsibilities

To use certain features of FitTo, you must create an account. You are responsible for:

  • Providing accurate, current, and complete registration information
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us promptly of any unauthorized access or breach of security

You must be at least 18 years of age or the age of legal majority in your jurisdiction to use the Service. Accounts must be held by individuals or entities with the authority to enter into binding agreements.

3. User Content and Intellectual Property

Your Content. You retain all rights to the content you upload to FitTo, including product designs, images, model photos, and other materials ("User Content"). By uploading User Content, you grant FitTo a non-exclusive, worldwide, royalty-free license to use, process, store, and display your User Content solely to provide, operate, and improve the Service.

Representations. You represent and warrant that you own or have the necessary rights, licenses, and permissions to upload User Content and to grant the license above. You shall not upload content that infringes any third-party intellectual property or other rights.

AI-Generated Output. Output generated by the Service (including AI models and virtual try-on images) is derived from your User Content. Subject to your compliance with these Terms and payment of applicable fees, you retain ownership of such output for use in your business. FitTo retains no ownership interest in your business content or outputs.

4. Acceptable Use

You agree to use FitTo only for lawful purposes and in compliance with applicable laws. You shall not:

  • Use the Service to create content that is illegal, harmful, defamatory, or infringing
  • Upload content depicting minors or use the Service in any way that harms or exploits minors
  • Attempt to reverse engineer, decompile, or extract the source code of the Service
  • Circumvent usage limits, security measures, or access controls
  • Resell, sublicense, or redistribute the Service without our prior written consent
  • Use the Service to build competing products or services
  • Interfere with or disrupt the integrity or performance of the Service

We reserve the right to suspend or terminate accounts that violate these acceptable use terms.

5. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime. We are not liable for any loss or damage arising from service unavailability.

6. Payment Terms

Paid subscription plans, usage-based pricing, and payment terms are described on our pricing page and in your subscription agreement. By subscribing to a paid plan, you agree to pay all applicable fees in accordance with the billing cycle. Fees are non-refundable except as required by law or as explicitly stated in our refund policy.

We may change pricing with reasonable notice. Continued use of the Service after a price change constitutes acceptance of the new pricing. Failure to pay applicable fees may result in suspension or termination of your account.

7. Intellectual Property

FitTo and its licensors retain all rights, title, and interest in and to the Service, including the FitTo brand, website, software, APIs, algorithms, user interfaces, and underlying technology. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent. You may not remove or alter any proprietary notices on the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FitTo AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising from or relating to your use of the Service, including loss of profits, data, goodwill, or business opportunities.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED INDIAN RUPEES (₹100). Some jurisdictions do not allow certain limitations of liability; in such cases, our liability shall be limited to the maximum extent permitted by law.

9. Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms or non-payment of fees.

Upon termination, your right to use the Service ceases immediately. We may delete your User Content after a reasonable period. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, limitation of liability, indemnification, and governing law.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. The courts of India shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Service.

11. Dispute Resolution

Before initiating any legal proceeding, you agree to first contact us at +91-9403832212 and attempt to resolve the dispute informally for at least thirty (30) days. If the dispute cannot be resolved, it shall be subject to the exclusive jurisdiction of the courts of India.

12. Modifications

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and may terminate your account.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' intent.
